Ordinance No. 834: Solid Waste Part 1 Amendment

This ordinance amends Chapter 20, Part 1 of the Hollidaysburg Borough Code of Ordinances — titled “Solid Waste and Recyclables Storage, Collection, Disposal and Processing” — to update regulations for municipal waste handling.

Key Changes & Requirements

  • Vehicle Equipment: All motor vehicles or trucks hauling municipal waste must be equipped with a fireproof and leak-proof compacting compartment.
  • Dump Truck Use: Dump trucks are now permitted to collect only bulky oversized waste or recyclables (not general municipal waste).
  • Licensing Removed: The requirement for haulers of municipal waste to be licensed has been deleted.
  • Standards & Reporting: All haulers must still conform to certain standards and reporting requirements.
  • Enforcement Authority: The Blair County Solid Waste Department is authorized to enforce this part of the ordinance.
  • Effective Date: The ordinance becomes effective on December 31, 2008.

Definitions Updated (§103)

The ordinance clarifies key terms:

  • Bulky Waste: Municipal waste too large/heavy for standard 30-gallon bags or receptacles — includes appliances, furniture, auto parts.
  • Construction/Demolition Waste: Includes wood, plaster, metals, asphaltic substances, brick, block, unsegregated concrete, dredging waste — but excludes clean fill materials like soil or rock used for leveling.
  • Hazardous Waste: Defined per federal law; excludes coal refuse and treatment sludges from mine drainage under specific permits.
  • Municipal Waste: Garbage, refuse, industrial lunchroom/office waste from residential, commercial, institutional establishments or community events — excludes source-separated recyclables.
  • Hauler: Person who collects, transports, and disposes of municipal waste or recyclables from residential/commercial/industrial establishments.

Intent & Purpose (§102)

The goal is to promote public health, safety, and welfare by eliminating hazards, pollution, and economic loss. All refuse must be collected and removed by responsible haulers and disposed of in authorized areas compliant with state, federal, and local laws.
