Key Conditions for Permit Holders

1. Barriers and Warning Devices

  • The Permittee must provide and remove all necessary barriers and warning devices.
  • These must be installed under the direction of the Chief of Police.

2. Cleanup Responsibility

  • The Permittee is responsible for collecting and removing all trash, garbage, litter, and recyclables generated by the event.

3. Liability Insurance and Indemnification

  • The Permittee must indemnify (protect) the Borough, its officials, employees, volunteers, etc., from any lawsuits or claims arising from the event.
  • Must carry property and liability insurance with minimum limits:
    • $1,000,000 per occurrence
    • $1,000,000 total for all occurrences
  • The Borough and its personnel must be named as “additional insured” on the policy.
  • A Certificate of Insurance must be submitted to the Borough Manager at least 7 days before the event.

4. Reimbursement for Borough Personnel

  • If Borough staff work overtime or outside regular shifts due to the event, the Permittee must reimburse them for those hours.

5. Fees for Borough-Provided Equipment

  • The Borough may charge a reasonable fee if it provides barriers, signs, or other protective equipment.

6. Street Marking Rules

  • Only chalk that fades within 30 days may be used to mark streets, sidewalks, or public rights-of-way.
  • Alternative temporary marking materials require prior written approval from the Borough Manager.

7. No Damage to Surfaces

  • The Permittee must not puncture or disturb any paved or concrete surfaces in public right-of-way areas.

Permit Revocation and Effectiveness

8. Revocation Authority

  • The Borough Manager or Chief of Police can revoke the permit at any time for reasons including:
    • Emergency, disaster, riot, traffic issues
    • Violation of laws or permit conditions
    • Undue burden on public services
    • Threats to public health, safety, morals, or welfare
  • Notice of revocation must be delivered in writing (personal service, certified mail) — or orally/in writing via phone/email if the event has already started.

9. When Permit Becomes Effective

  • The permit is not effective until this Attachment is:
    • Signed by the applicant
    • Returned to the Office of the Borough Manager at:
      401 Blair Street, Hollidaysburg, PA 16648

Applicant Acknowledgment Section

The form includes spaces for the applicant to:

  • Sign
  • Print their name
  • Date the signature

By signing, the applicant confirms they have read and agree to all conditions in this attachment as part of their permit application.
