Ordinance No. 881: Zoning Amendment Summary

This ordinance amends the Borough of Hollidaysburg’s Zoning Ordinance (Chapter 27) to update parking requirements for certain land uses, particularly group residences and small businesses. It was enacted on August 9, 2018.

Key Changes

Section 1: Group Residence Parking Rules

  • Applies to: Group residences in C-2 Districts (except where §508(3)(D) sets maximum parking limits).
  • New rule:
    • Ignore standard minimum parking for normal residences.
    • Provide at least:
      • One off-street space per staff member (on peak shift), plus
      • One space per two residents who own/operate motor vehicles.
    • Must follow §§508(1) and 508(2) for space design.
    • Changing a building’s use to/from group residence does NOT allow elimination of existing required parking from prior use.

Section 2: Differentiated Parking by Zoning District

  • Goal: Protect residential character, promote efficient space use in dense urban areas, encourage historic building reuse, reduce stormwater runoff.
  • Applies to: R-1, R-2, R-3, PR, RB, HS, and CR Districts.
  • For land uses marked with asterisk (*): Chart below shows minimum parking spaces.
  • For other land uses: Chart shows maximum parking spaces — total must be approved by Borough Council with Planning Commission and Borough Engineer recommendation.

Off-Street Parking Requirements (Selected Examples)

Land Use → Required Spaces

  • Agricultural service business: 1 space per 400 sq. ft. enclosed gross floor area
  • Art gallery/museum: 1.2 spaces per 1,000 sq. ft.
  • Auditorium/noncommercial movie theater:
    • 1 space per 4 fixed seats OR 6 linear feet of fixed benches; if no seating, 1 space per 75 sq. ft.
  • Automobile parts store: 1 space per 300 sq. ft.
  • Automobile repair shop: 1 space per service bay (bay doesn’t count as parking)
  • Automobile sales:
    • 1 space per 600 sq. ft. enclosed + 100% of additional spaces needed for other uses on same lot (e.g., repair shop)
    • Plus: 170 sq. ft. lot area per vehicle stored on premises
  • Bait shop: 1 space per 300 sq. ft.
  • Bakery:
    • First 25,000 sq. ft.: 1 space per 500 sq. ft.
    • Next 25,000 sq. ft.: 1 space per 650 sq. ft.
    • Over 50,000 sq. ft.: 1 space per 800 sq. ft.
  • Bank/financial institution:
    • 1 space per 300 sq. ft. + 3 reservoir waiting spaces (min 20 ft long) at each drive-in window
  • Bar/tavern/nightclub/dance hall: 1 space per 100 sq. ft.
  • Basketball/tennis/racquetball court:
    • 5 spaces per court OR 1 space per 3 spectator seats — whichever is greater
  • Beauty parlor/barber shop: 1 space per 200 sq. ft.
  • Bed and breakfast establishment (*):
    • 1 space per guest bedroom + 2 spaces for permanent residents
  • Beverage distributor: 1 space per 350 sq. ft.

Additional Land Uses (Page 3)

  • Bicycle repair shop: 1 space per 350 sq. ft.
  • Boarding house (*):
    • 1 space per guest room + 50% of parking required for other commercial uses in same building (e.g., restaurant)
  • Bookstore: 1 space per 250 sq. ft.
  • Bowling alley:
    • 3 spaces per alley + 50% of additional parking for other uses on premises (e.g., restaurant, bar)
  • Building/plumbing/welding/heating supplies store:
    • 1 space per 500 sq. ft. for display + 1 space per 1,000 sq. ft. warehouse area + 1 space per company vehicle
  • Campground: 1 space per campsite
  • Car wash:
    • 1 space per employee + storage for 5x number of cars in wash process at any one time
  • Cemetery: 1 space per employee
  • Clubs/lodges: 1 space per 300 sq. ft.
  • Community center: 1 space per 300 sq. ft.
  • Contractor’s yard:
    • 1 space per 2,000 sq. ft. OR 1 space per employee — whichever is more
  • Convalescent center/nursing home (*): 1 space per 600 sq. ft.
  • Convenience store:
    • 1 space per 200 sq. ft. + 80% of additional parking for other uses on same premises (e.g., gasoline station)
  • Convent/monastery/religious residence (*): 1 space per 1,000 sq. ft.

Section 3: Small Business Exception

  • Exemption: Commercial enterprises using less than 7,000 sq. ft. of an existing building (not new construction) are exempt from providing off-street parking.
  • Rationale: Encourage reuse of existing buildings; recognize availability of existing lots and on-street parking.

Sections 4–6: Legal Provisions

  • Section 4: Severability clause — if any part is invalid, rest remains enforceable.
  • Section 5: No other amendments made; unamended provisions remain in full force.
  • Section 6: Effective upon earliest date allowed by law.
