Chapter 16: Parks and Recreation — Part 1 Summary This document outlines regulations for public parks and recreation facilities in the Borough of Hollidaysburg, PA. It covers definitions, operating hours, prohibited conduct, rule-making authority, closure procedures, enforcement, and penalties. Key Definitions (§101) PARK or PARKS : Includes all parks, playgrounds, recreation areas, tennis courts, beaches, structures, facilities, entrances, approaches, and any land or property owned/acquired by the Borough for park/recreational purposes. PERSON : Any natural person, corporation, organization, company, association, or partnership. RULES and REGULATIONS : Rules promulgated by the Borough Council under this chapter’s authority. Park Hours (§102) Parks are open daily at hours designated by the Borough Manager. No person may be in attendance between 10:00 p. m. and sunrise, unless special permission is granted by the Borough Manager. Prohibited Conduct (§103) No person shall: Injure, deface, remove, cut, or damage trees, plants, shrubs, turf, buildings, structures, signs, benches, seats, tables, playground apparatus, or other fixtures/property of the Borough located within the park. Litter with garbage, paper, bottles, cans, or waste material — disposal only allowed in designated receptacles. Authorization to Promulgate Rules (§105) The Borough Manager is authorized to establish and enforce additional rules and regulations necessary to carry out the purposes of this part. Amended by Ordinance 761 on July 1, 1999. Authority to Close Areas (§106) Recreation facilities may be closed at the Borough Manager’s discretion if hazardous due to weather, water, fire, or unforeseeable conditions. Enforcement (§107) The Borough Manager is responsible for enforcing this part and any rules/regulations promulgated under it. Amended by Ordinance 761 on July 1, 1999. Penalties (§108) Violators may be sentenced to: A fine of not more than $1,000 , AND/OR Imprisonment for up to 90 days . Effective Dates & Ordinances Original adoption: Ordinance 749, August 21, 1997. Amendments: Ordinance 761, July 1, 1999 (applies to §§105 and 107). Residents should note that park access is restricted overnight without permission, littering and vandalism are strictly prohibited, and violations can result in fines or jail time. The Borough Manager has broad authority to manage park operations, including closing facilities for safety and adding new rules as needed.
