Overview
This document is a Campaign Finance Statement form for the Commonwealth of Pennsylvania. It serves as an abbreviated report that candidates, committees, or lobbyists may file instead of a full financial report.
Eligibility and Filing Rules
- Threshold: This simplified form may only be used if aggregate receipts, expenditures, and liabilities incurred during the reporting period did not exceed $250. 00.
- Where to File: The statement must be filed in the office where the candidate's nomination petitions or papers were filed.
- Separation: Candidates must file a separate statement from their authorized committees.
Reporting Schedule
Reports must be filed according to specific cycles relative to the election date:
- Cycle 1 (Sixth Tuesday Pre-Primary): Required only for statewide candidates and their committees.
- Cycle 2 (Second Friday Pre-Primary): Required for all candidates on the ballot and their committees.
- Cycle 3 (30 Days Post-Primary): Required for all candidates on the ballot and their committees.
- Cycle 4 (6th Tuesday Pre-Election): Required only for statewide candidates and their committees.
- Cycle 5 (2nd Friday Pre-Election): Required for all candidates on the ballot and their committees.
- Cycle 6 (30 Days Post-Election): Required for all candidates on the ballot and their committees.
- Annual Report: Due by January 31st of the following year (complete as of December 31).
Penalties and Compliance
- Late Filing: A penalty of $10. 00 per day (excluding weekends and holidays) applies for overdue statements, plus an additional fee of $10. 00 for each of the first six days overdue.
- Legal Consequences: Failure to file required accounts is a misdemeanor punishable by a fine up to $5,000 and/or imprisonment of 1 to 2 years.
- Record Keeping: Filers must retain records for 3 years, including names and addresses of contributors who gave over $10. 00.
- Proof of Filing: Postmarks are acceptable proof of timely filing if sent via first-class mail.
Form Requirements
The form requires the filer to provide:
- Identification numbers and names of the candidate, committee, or lobbyist.
- Address details (Street, City, State, Zip).
- Office sought and district information.
- Cash balance at the end of the reporting period.
- Total outstanding debts or liabilities.
Affidavit Section: The form concludes with an affidavit section requiring a sworn statement (Part I or Part II) signed by the Treasurer, Candidate, or Lobbyist. This section must be notarized ("Sworn to and subscribed before me") with the notary's commission expiration date.
